Terms of use
The basis on which this website may be used, what belongs to the foundation, and what the site does not promise.
This website
What these terms cover
These terms govern the use of nkemjika.org. Reading the site, or sending anything through it, means accepting them. If you do not accept them, the position is simply that the site is not for you to use.
The site is published by the Nkemjika Development Foundation, a Nigerian non-profit. The foundation's registration status is stated on the governance page and nowhere else, so that it is stated once and stated correctly. Nothing on this website is an offer, a contract of employment, or a promise of a grant.
These terms sit alongside the privacy notice, which deals with personal data, rather than repeating it.
Using the site
What you may do, and what you may not
You are welcome to read the site, to quote short extracts from it, and to link to it. Quoting is welcome where the foundation is named and the page is linked, so that a reader can check the source rather than take the extract on trust.
You may not use the site unlawfully. You may not attempt to reach any part of it you have not been given access to, interfere with it or with anybody else's use of it, take it down, or overload it — by hand or by automated process. You may not copy it wholesale, and you may not harvest contact details from it for a mailing list, a fundraiser or anything else.
You may not say or imply that the foundation endorses you, your organisation, your product or your cause when it has not said so in writing. Raising money, or collecting donations, in the foundation's name without written agreement is not permitted.
Our content
Copyright, the foundation's name and its marks
The text, photographs and design on this site belong to the foundation, or are used with the permission of whoever owns them. They are protected by copyright. Short extracts quoted with attribution and a link are fine; republishing any substantial part of the site, or using the foundation's photographs or written work in your own material, needs written permission first.
The foundation's logo is supplied artwork and is to be used as supplied. It is not to be redrawn, recoloured, cropped, stretched, separated into its parts, or rebuilt by any other means, and it is not to be set inside another design in a way that suggests a partnership that does not exist. The same applies to the foundation's name used as a mark.
If you want to use the logo or the name, ask. Permission is often given, and it is given in writing so that there is no doubt later about what was agreed.
Photographs
The people in them, and consent
Photographs of identifiable people are published only where the foundation holds a consent record for them. Where the foundation cannot satisfy itself that consent exists, the photograph is withheld — which is why some of its own material does not appear here.
If you appear in a photograph on this site and want it removed, write to the address on the contact page and say which photograph and which page. The image is taken down while the question is looked into, rather than left in place until it is resolved. You do not have to explain yourself, and no reason is needed.
Links
Other people's websites
This site links to other websites, and other websites link here. A link is not a recommendation, an endorsement, or a statement that the foundation has checked what is on the other end of it. The foundation is not responsible for the content, the accuracy or the privacy practices of sites it does not run, and following a link is at your own risk.
Linking to this site is welcome. It should not be done in a way that implies the foundation has approved your site, and it should not be done inside a frame that makes the foundation's pages look like part of your own.
Giving
Donations
A donation made through this site is voluntary. Nothing is supplied in return for it: no goods, no services, and no right to direct how the money is used or who receives it. The foundation decides how funds are applied, subject to its own governance.
Card details are never handled by the foundation. Payments are taken by a payment provider on its own secure pages, and the foundation is told the outcome — not the card. Where the foundation settles a payment that did not complete, it does so by asking the provider directly.
Donations are not refundable, except where a payment was made in error or taken without the donor's authority. If that has happened, write to the address on the contact page and it will be looked into and, where the position is clear, returned.
Whether a donation attracts any relief from tax depends on your own circumstances and on Nigerian law, and it is a question for your own adviser. The foundation does not give tax advice and does not promise any tax treatment of a gift.
What we do not promise
Accuracy and availability
This website describes the foundation's work. It is published in good faith, and it is kept current, but it is not a formal record and it is not professional advice of any kind. Where a figure appears, its source is named so that it can be checked; the document it comes from is the authority, not this page.
The foundation does not promise that every statement here is complete, that it is still accurate by the time you read it, or that the site will be available when you want it. The site may be taken down for maintenance or changed without notice. Where something in a report or a financial statement matters to you, ask the foundation for the document itself and rely on that.
Responsibility
The limits of the foundation's liability
To the extent Nigerian law allows, the foundation is not liable for loss or damage that is indirect, incidental or consequential, nor for loss of profit, data or opportunity, arising out of the use of this site or of anything reached through it — including where the site has been unavailable, or where something published on it has turned out to be wrong.
Nothing in these terms limits any liability that cannot lawfully be limited, and nothing in them removes your rights under Nigerian law.
Complaints
If something here is wrong, or is yours
If material on this site infringes a right you hold, or states something about you that is wrong, write to the address on the contact page. Identify the material and the page it is on, and say what the position is. Enough to find it is enough — a formal notice is not required.
Material that is the subject of a genuine complaint is taken down while the question is looked into. The foundation would rather remove something and restore it than leave it up and argue about it.
This is not the route for a safeguarding concern or a report of wrongdoing about the foundation itself. Those go through the reporting page, where the handling is different — including who is able to see them.
The law
Which law applies
These terms are governed by the laws of the Federal Republic of Nigeria, and any dispute arising out of the use of this site falls to the courts of Imo State, where the foundation works.
Changes
If these terms change
These terms may be updated as the foundation's work and the site change. The version in force is the one published here, and the date below is its date. Where a change is material rather than editorial, the foundation will say so rather than leave it to be discovered.
Terms of use — this version
The version above has been in force since 14 October 2026. If anything in it is unclear, ask and it will be explained.
